TERMS AND CONDITIONS OF PURCHES FROM BALTIC.SE

These conditions apply when you as a consumer (hereinafter referred to as “you”) place orders with Baltic Safety Products AB (hereinafter referred to as “Baltic”), via our e-commerce store baltic.se baltic.se (hereinafter referred to as “the Site”). By using and / or placing an order via the Site, you accept the terms stated here, and confirm that you have read the information about how your personal data is processed, and our use of cookies.

To shop from us, you must be over 18 years old, not under guardianship and be resident in Sweden, Denmark, Germany, Finland, The Netherlands, Norway, Austria and UK.

We reserve the right in individual cases to refuse or change your order (for example, if the item you have ordered is out of stock).

ORDER CONFIRMATION
Ordering of goods can be done via the Site. Once you have placed an order, Baltic will send an order confirmation to the email address you have provided. Only when you have received the order confirmation has an agreement been entered into. We recommend that you save the order confirmation for any contacts with us.

These general terms and conditions, together with the order confirmation, constitute the contractual basis for your purchase. The agreement and other information related to the contractual relationship are provided in Swedish and English. You can contact us at any time and have a copy sent to you.

MANAGEMENT OF YOUR PERSONAL DATA
To be able to place an order, you need to provide us with some information about yourself. In our privacy policy, you can read about how we process your personal data.

 

ORDER AND PRICES
When ordering via the Site, the prices that were relevant at the time of ordering apply, regardless of whether the price goes up or down afterwards. All prices on the Site are stated in SEK, EUR or GBP, depending on the language you have set. All prices are stated including VAT but excluding any shipping costs and invoice fees. Fees and costs may vary depending on the choice of payment method and delivery method. Shipping of SEK 39 will be added to all orders under SEK 800 within Sweden. Shipping of 4 EUR or 6 GBP will be added to all orders under 80EUR outside Sweden within EU. Current costs and fees are always stated before you complete your order. Outside EU custom fees could be needed to pay by the buyer, this will not be shown on your order.

 

PAYMENT
Through cooperation with various payment service providers, we can offer the following payment methods. Note that for certain payment methods, the payment service provider’s contract terms (which may include costs / fees) and privacy policies apply. We encourage you to carefully read such terms and conditions before choosing a payment method.

Klarna

The invoice is sent out separately via email in connection with the order being sent from us. The credit period on the invoice is 14 days. More information and complete terms and conditions about Klarna’s payment methods can be found at Klarna.com, or by contacting Klarna’s customer service on telephone 08-120 120 10.

In order to offer you Klarna’s payment methods, we may at the checkout share your personal information in the form of contact information and order information with Klarna, so that Klarna can assess whether you can choose the payment methods, and to adapt them for you. Your personal data that is shared is processed according to Klarna’s own data protection information.  Klarna privacy information.

Have you paid with a gift card or used a discount code? Save this information after completing the purchase. In the event of a return of the product, you can contact us at webshop@baltic.se to reactivate your code.

 

DELIVERY AND TRANSPORT
We strive to deliver as soon as possible after the agreement has been entered into. Delivery time may vary depending on whether the goods are in stock.

Within Sweden, we send our packages with Postnord and within EU and Uk Postnord, DHL or UPS. In case of delivery delay, we will notify you of this and continue to monitor the order. Unless otherwise specifically agreed, you have the right to cancel the order if the delivery time should presumably exceed 30 working days and this does not depend on you as a customer.

 

UNCOLLECTED PACKAGES
When delivered to a postal agent, you pick up the goods against identification. Delivery can be notified by email, post or text message. The item is considered delivered when you have picked up the shipment. If you do not pick up the notified consignment within the set time, the consignment will be returned to us. We then have the right to charge you a shipping and return fee of SEK 95.

 

RIGHT OF WITHDRAWAL
You always have a 30-day right of withdrawal when purchasing goods on the Site. This means that you have the right to cancel your purchase by notifying us within 30 days of you or a person specified by you receiving the ordered item (the withdrawal period). You exercise the right of withdrawal by leaving us a notice to this effect on the contact information stated above. You can always fill in the Consumer Agency’s standard form which is available at www.konsumentverket.se or the standard form that we sent to you at the conclusion of the agreement and send to us.

If you exercise your right of withdrawal, you must within 30 days of notifying us that you regret, at your own expense, return / send the item to us, read about how to return the items under “Returns” below.

When you exercise your right of withdrawal, we will refund the amount you paid for the product, excluding environmental tax, as soon as possible but no later than within 14 days after we have received your notice of use of the right of withdrawal and provided that we have received the goods back from you or proof that you have returned the goods.

If you want to exercise your right of withdrawal and receive a full refund, you only have the right to handle the product to the extent necessary to determine its properties and function. For example, you of course have the right to try on a purchased life jacket but not use it outdoors. Should you have handled the item to a greater extent than this, we reserve the right to deduct an amount from the amount we refund. The price reduction shall correspond to the reduction in value that has taken place compared with the original value of the product in new condition.

If you have chosen to pay through Klarna, we recommend, in order to avoid a payment reminder from Klarna, that you pay the invoice, in order to have it refunded later. You can also advance the invoice due date. Klarna normally charges a small fee for this. To advance the invoice due date, visit Klarna.com, contact Klarna’s customer service on telephone 08-120 120 10, or log in to your account in Klarna’s app. When we have received the goods in return, the amount for the item (s) you have returned will be refunded and Klarna will notify you of an updated invoice via email. If the order has already been paid, Klarna will notify you of a refund. Refunds will be made without delay (normally within a few banking days) from the time we receive the item (s) in return.

 

RETURNS
To return an item, you can use the pre-printed return slip that came with your package for an environmental fee of 39SEK in within Sweden and 6EUR within EU and UK. If you do not have a return slip – contact us.

The item must always be sent in original packaging if you received it with the purchase, e.g. carton and accompanying packaging. The original packaging must be in its original condition. Do not put tape or labels directly on the original packaging.

If you choose not to use the pre-printed return slip, the return must be sent by company post directly to our warehouse. If your return is sent to a terminal or agent, it will normally remain for 14 days before it is returned to you. Contact us at webshop@baltic.se for more information.

 

CHANGE TO ANOTHER GOODS
Unfortunately, we do not have the opportunity to change size via email or message on the return slip. If you want to change an item, you therefore need to exercise your right of withdrawal as above and place a new order.

 

COMPLAINTS
You have the right to complain about goods that are incorrect in accordance with current consumer protection legislation. Should you receive a defective or incorrectly delivered item, contact us at webshop@baltic.se.

The complaint must be made within a reasonable time after you have discovered or should have discovered the error or defect and must be directed to the seller, ie. Baltic, if you have purchased the product via the Site. If you have bought your Baltic product from one of our retailers, we ask you to contact your place of purchase for help with your complaint. Complaints that occur within two (2) months after you have noticed the error must always be considered to have been made in due time. Such notice may be given to Baltic orally or in writing, but for reasons of proof we recommend that you send the complaint to us in writing. The right to complain is valid for three (3) years after you received the product.

In the event of a complaint, you must return the wrong product to us, read more about how to return the goods under “Returns” above. If the product turns out to be faultless, we are entitled to compensation for shipping and inspection costs.

In the event of a complaint, you must always present a receipt or proof of purchase.

 

GUARANTEE
We provide a five (5) year warranty on our safety products with the exception of floating clothing which has a warranty period of two (2) years. We provide a two-year guarantee on other clothing / clothing. The guarantee only applies to material or production defects. The warranty only covers the repair of the product, or exchange for a new equivalent product. The guarantee presupposes that the product has only been used for private use, has not been exposed to an accident and that normal care has been applied and the instructions for use have been followed. DELAYED DELIVERY
In the event of a delay of 30 days, you can cancel the purchase free of charge if you do not approve a new proposed delivery time. Have you paid in advance and want to cancel the purchase due to delayed delivery we will refund you. If you have not received notification that the package is available for collection within the estimated delivery time on the order confirmation, please contact us at  webshop@baltic.se.

 

CHANGE OF INFORMATION ON SENT ORDERS
It is important to check that the name and address are correct before you complete your purchase. The name must be written exactly as it says on your ID. Unfortunately, we are not able to change information on an order that has already been sent. If the order cannot be picked up, the package remains with the agent for 14 days. If you provide an incorrect email address and / or telephone number, this may lead to you not receiving any notification that your order has arrived at your agent. if something is went wrong, contact us at  webshop@baltic.se.

 

APPLICABLE LAW AND DISPUTE
We value you as a customer highly and always want to help you. In the event of complaints and any disputes that we do not succeed in resolving, we recommend that you contact the General Complaints Board,  www.arn.se, or Box 174, 101 23 Stockholm. We always follow their advice. You can also use the European Commission’s website http://ec.europa.eu/odr for complaints. The terms are interpreted in accordance with Swedish law.

 

TERMS FOR B2B WHEN PURCHASING ON BALTIC.SE


These conditions apply when you as a corporate customer (hereinafter referred to as “the Buyer”) order goods from us, Baltic Safety Products AB (hereinafter referred to as “Baltic”). By completing the order / making an order, the Buyer agrees that these conditions are applied.

PRICE AND TERMS OF PAYMENT
The price of the goods is stated in Baltics’ current price list for corporate customers. All prices are stated excluding VAT. Baltic reserves the right to make price and printing errors. For orders placed by phone or email, Baltic may charge an administration fee. Additional fees and / or costs attributable to the purchase, e.g. shipping costs, may be added, which are specified in connection with your order and / or in the quote.

Unless otherwise agreed in writing between the parties, payment must be made no later than 30 days after the invoice has been sent. In the event of delay in payment, an annual default interest of 7.5 percentage points is calculated from the due date of the invoice until payment has been received. Baltic also has the right to charge a reminder fee, delay fee and other collection costs that are associated with the late payment.

 

RETURN RESERVATION
The goods sold remain the property of the Baltics until they have been paid for in full. Should the goods be foreclosed on or the Buyer is declared bankrupt, it is the Buyer’s responsibility to notify Baltic immediately, and to inform the bailiff, the Swedish Enforcement Agency or the bankruptcy trustee of Baltic’s ownership of the goods.

Baltic reserves the right to take back the goods if the Buyer does not pay in accordance with the agreement.

Upon repossession of the goods, unless otherwise agreed in writing between the parties, the goods, at the Buyer’s expense and responsibility, shall be sent to the address specified by Baltic. All costs in connection with the repossession shall be paid by the Buyer.

 

WARRANTY TIME
With the exception of life jackets and life jackets that are suitable for professional use, Baltic provides a five (5) year guarantee on our safety products. Baltic provides a two (2) year warranty on other clothing / clothing (including life jackets and life jackets suitable for professional use). The guarantee only applies to material or production defects. The warranty only covers the repair of the product, or exchange for a new equivalent product. ORDER BASIS
Received orders and / or orders must contain complete information about the Buyer, this includes e.g. organization number, delivery address and contact details.

 

ORDER RECOGNITION
Baltic reserves the right to make a credit check of the Buyer before an order is accepted.

If Baltic accepts an order, the order acknowledgment is sent to the email address specified by the Buyer. The order approval is the basis for the order and is expected to be reviewed by the Buyer within 48 hours of the order approval being sent. After 48 hours, the Buyer is deemed to have approved the order recognition unless otherwise notified to Baltic..

DELIVERY AND SHIPPING TERMS
Baltic hires a supplier for delivery of the products. Estimated delivery time, shipping cost and other delivery terms are specified in connection with the order and / or in the respective quote.

 

COMPLAINT
The buyer is obliged to check the goods upon receipt. If the delivery does not match the order, the goods are damaged or otherwise faulty, the Buyer is obliged to notify Baltic immediately. The Buyer may not invoke defects in the delivery or in an individual item unless it notifies Baltic of the defect within ten (10) working days of the Buyer receiving the goods.

Unless otherwise agreed in writing, defective goods must be returned to: Baltic Safety Products AB, Industrivägen 7, 545 72 Älgarås.

If the product proves to be faultless, Baltic is entitled to compensation for shipping and inspection costs.

 

PENALTIES IN CASE OF ERROR
If the product is defective and it is not due to the Buyer or any relationship on the Buyer’s side, Baltic shall, with the urgency that the circumstances call for, remedy the defect by repair or re-delivery.

 

 LIMITATION OF LIABILITY, FORCE MAJEURE
Baltic is released from the obligation to compensate for damage or to fulfill a certain obligation if the damage or omission is due to circumstances beyond Baltic’s control (“Force Majeure”) and which prevent, significantly impede or delay the fulfillment of such an obligation. The same applies if the damage or omission is due to delayed deliveries from the Baltic subcontractor caused by Force Majeure. Such as Force Majeure can be considered i.a. natural disaster, labor dispute, strike, fire, virus outbreak, war or threat of war, change in government regulation, ordinance or law, or government intervention.

Baltic is prevented from fulfilling the agreement due to Force Majeure shall Baltic notify the Buyer of the obstacle and its impact and if or when fulfillment is expected to take place. Baltic has the right to extend the delivery time corresponding to the time that the impediment remains and a reasonable additional time for fulfillment of its obligations.

Baltic is not liable for any indirect damages such as, but not limited to, compensation to third parties, lost profits, other loss or other consequential damages. Baltic’s liability for damages shall never amount to more than the amount corresponding to what the Buyer has paid for the item / items covered by the breach of contract. The limitation of liability in this paragraph does not apply to the extent that such a limitation is contrary to forced laws such as the Product Liability Act (1992: 18) or the Product Safety Act (2004: 451).

 

LAW AND DISPUTE
Swedish law shall apply to this agreement. Disputes in connection with this agreement shall be decided by a court with Skaraborg District Court as the first instance.
